O'Leary, the Shark Tank investor, ties institutional money to a law, not an agency rulebook.

"Bitcoin's going nowhere until the CLARITY Act becomes law," he said that on Fox Business in June.

Two months on, the bill has not moved. Other forecasters pin a $200,000 Bitcoin target to passage.

The market is not pricing that. The Bitcoin price today sits near $64,126, up 0.5% on the day. Polymarket contracts on a 2026 signing trade at 17% across $5.03 million in volume, down from above 70% in February.

Galaxy analysts cut their passage odds in June, blaming the calendar rather than the policy.

CFTC Chairman Michael Selig has rule proposals ready to go. He intends to use them with or without Congress, Law360 reported this week. He can act fast because he is the only sitting commissioner on a five-seat panel.

That path is reversible, though. A successor can undo agency rules without a vote. A statute outlasts the next election. Former CFTC Chairman Chris Giancarlo argues crypto innovation continues either way.

Thune can still file on Friday and drag a vote into the weekend.

If he does not, the GENIUS timeline says the bill is not dead. It just gets three weeks in September to prove it.
