Malaysian Court Rejects Negeri Sembilan’s Bid to Evict Two Undangs’ Residences

Market Impact

KUALA LUMPUR: The High Court in Seremban today dismissed Negeri Sembilan’s application to evict the official residences and halls of the Undangs of Rembau and Sungai Ujong. Judge Roz Mawar Rozain ruled via an online hearing at approximately 4:30 pm, citing the state government lacked legal standing under Order 89 of the Rules of Court.

The court found that under Section 16 of the National Land Code (NLC), only the Negeri Sembilan Director of Land and Mines may initiate legal proceedings on behalf of the state regarding disputed reserve land. Judge Roz Mawar noted the state government failed to prove ownership or statutory capacity to sue for trespass or possession.

The respondents included Abdul Rahim Yasin and Datuk Mubarak Dohak, former Undangs of Rembau and Sungai Ujong, along with occupants of the disputed premises. The state was represented by lawyer Muhammad Hariz Md Yusoff, while Choo Shi Jin and Asmawi Ismail appeared for the respondents.

The court ruled the properties in question are reserve land under the NLC, not state land, and thus the state lacked authority to file the suits directly. Judge Roz Mawar also clarified that the removal of the Undangs did not confer legal ownership or resolve disputes over their titles.

The High Court ordered Negeri Sembilan to pay RM25,000 in legal costs for two dismissed suits totaling RM50,000 to the first respondent.
